These headlines make the outcome seem more outlandish than it really is—if they had said “Man awarded $450K after being fired for not attending lunch-time office party” it would seem much more normal. The only crazy part of this story is that he was fired for something as trivial as not attending an office lunch event.

I don't think a doctor that does the cuckoo gesture would be doing the defense any favors as that would actually confirm the plaintiff's claim of having a psychological affliction. The direction the defense wants their witness to go would be that the anxiety disorder doesn't normally debilitate a person from attending birthday parties and that the plaintiff is probably lying or exaggerating symptoms.

I know where he was comming from. I cannot be in crowds of people and it is worse when their focus is on me. The jury was right its a fobia and cannot be controled

i told my wife over the years, (casually, not emphatically ) that i didnt want a birthday celebration hoping secretly id get a surprise one, 30 came and went… 40 came and went…50 came and went… ect. i never got one. she said she didnt want one either, i organised a small one for her 40th, and her 50th had to be in the town hall and was a genuine complete surprise. im not married and on my own now so the chances of getting one now are gone forever… nobody cares, it is what it is.

There are a few religious groups who do not want, nor will they accept, birthday celebrations/gifts/parties (correct me if I'm wrong, but the Jehovah's Witnesses may be in this category). Employers in Kentucky are proud of saying they can do what they want, when they want, as they want, with impunity; and that you can be fired for any reason, no reason, or even a false reason because of "at will" employment. Besides, in my workplace, there was never any time for a "party". (Edited for spelling)
