I enjoy watching you through your travels. I am long time owner- operator. Its great to see new drivers coming into this industry and doing so well. So I'm not an expert or an attorney or anything but here is my understanding: Unlike driving as a private citizen with certain rights, a commercial driver is under Federal guidelines as established by the FMCSA and enforced by commercially appointed officers, hence the term "commercial cop or DOT" and because you are a "for hire carrier" a DOT officer can search your vehicle and you without a warrant or cause. They can search your cab for alcohol whether open or closed and sealed you can not carry certain items in the cab of your truck (this is an example) You are also subject to a search of all your documents, licenses, insurance and complete compliance. This is known as a level 3 inspection (paper inspection only) if they wanted they could do a complete level 1 inspection, they do not need a reason to pull you over. Your ELD, logs, (even paper logs) must be accessible fully which is why he was asking for access to your cab, which if he wanted to push it could have done so, he was being nice and polite not making you. Typically they look back the last 7 days BUT can easily see back any amount of time that is on your logs, just because 7 days have passed doesn't mean you cant get a violation In fact under a DOT audit you can get a violation 6 mons later. Now as far as the violation for the 30 min break: the new rule reads like this: "30-Minute Break Rule Flexibility The dot hours of service 2019 changes allow 30-minute break flexibility by adding the break requirement to 8hours of driving time for at least 30 minutes without interruption. Thus, the 30-Minute proposed hours of service rule changes thereby enabling a driver to satisfy the break using on-duty, not-driving status, instead of off-duty." so he is is wrong in that violation.
